  One of the costliest investments that we make in life is buying or renovating our home. Imagine all of your hard earned money lost because you choose the wrong builder. You need to do your homework upfront and one of the best ways is check out the following web site: www.nahb.org The NATIONAL ASSOCIATION OF HOME BUILDERS has a unique section for consumers who are building or remodeling. They point out many of the items that you should be aware of. Don't let a slick talking contractor bully you into handing over tens of thousands of dollars for shoddy work. Know what your contract says you are entitled to. Assume nothing and arm yourself with knowledge. Make sure you request an "end date" so that the work isn't dragged out. Don't allow the contractor to do work that you did not agree upon or contract for. Some builders do a fine job when you are present and on site, but there is a noticeable difference in quality when there is no one to watch over the project. Make unscheduled visits while he is working and observe the quality of the work being done. Lastly, make sure they give you a certificate of insurance.

  If you are selling your empty lot or your home, you are required to provide the new buyer with a resale certificate. You can obtain this certificate from Alpine Lake Lot Owner's Association, Inc. The cost for the resale certificate is $200.00. Upon sale of your property, you must provide the Board of Directors with the name and address of the new lot owner.   As a lot owner in Alpine Lake, YOU, not your children, not your guests, YOU will be held responsible for any damage being done at the lake, pavillion or anywhere in Alpine Lake. A word to the wise, we have zero tolerance for drugs, underage drinking, violence or littering.

  There has been a lot of questions regarding the riding and operating of off road recreational vehicles, whether they are ATV/quad or trail bikes. They all come under Pennsylvania's All-terrain Vehicle Law. The State law is called "The Snowmobile and All Terrain Vehicle Law" and is contained in Chapter 77 of the PA Vehicle Code. The State regulations are in Title 17 Pa.Code Chapter 51. We will adhere to those guidelines. Some years ago, the community was upset over the number of atv's, etc that were running around the development. The Board was given the task to set up procedures to govern such use. The lot owner, not the rider will be subject to fine by ALLOA if any of the following guidelines are not followed. 1. You cannot ride on any township road. In other words you cannot ride on Alpine Lake Road unless you fall under the emergency exceptions. 2. You cannot ride your atv/quad/dirtbike on our private roads without our permission, no exceptions. You will be fined by the community. 3. You have to be 16 to ride on our roads, no exceptions. Ages 8-15 cannot ride on our property. They can however ride on your own private lot/home. 4. You have to present a certificate of safety training issued by the state. 5. You have to have an adult supervising your 16 year old when they cross Alpine Lake Road. 6. You must have a certificate of insurance naming Alpine Lake Lot Owner's Association Inc. as a co-insuree and then you will be given an ALLOA license for just our private roads. 7. You must follow the speed limits of 15 MPH at all times. The fines for any infractions mount up quickly. You will have to decide if it is even worth it to ride on our roads. Remember, your kids can ride on your property, but when they come onto our roads, they must follow all guidelines. NO EXCEPTIONS!

  Subterreanean termites live in the soil and during the winter, they are against the building foundations for warmth. In January, swarming termites gather as a way of starting new colonies. Subterranean termites need excessive moisture to survive. Make sure that rain water drains away from foundations. Keep shrubs trimmed away from foundations and don't store firewood against the foundation. If you are unsure as to how to treat affected areas, call a pro. Remember, what you put into the ground is what will end up in your well!

  Our development is located in Area 3 of Pocono Township and the new requirements are that the system must be cleaned every 4 years. Board Member, Ernie Temple has made arrangements with Allstate Septic Systems for a discount for Alpine Lake residents to have their systems cleaned. The normal charge for a 1000 gallon tank is $235.00, the charge to Alpine Lake residents is $200.00. Please note, their charge is for cleaning a 1000 gallon tank, so if your tank is larger, you'll pay more. All homeowners have to make the tank covers accessible. When you call Allstate, you can ask anyone there for the ALPINE LAKE SPECIAL.

  We, your volunteer Board of Directors would like to thank each one of you who took the time to vote for us at the annual election. It is gratifying to know that the job we are doing is appreciated. We will certainly continue to do the best for the community and for the trust you have placed in us. We realize that we can't please everyone, but we will certainly provide the continunity of governing within the bylaws and the "rules & regulations" to maintain a level of direction and focus for Alpine Lake.   Alpine Lake Lot Owners Association, Inc. has posted an article in the local newspaper to advise any and all persons building homes within our community that the dwelling is not to be occupied until a Certificate of Occupancy (C.O.) from Pocono Township is received and a copy is forwarded to the Board of Directors. Any lot owner occupying said structure without a C.O. shall be fined according to the ALLOA Notice Procedures. This information is being posted because Alpine Lake is seeing an increase in new building and we want to insure that we have a safe and clean environment for all members.   All lot owners and/or their builders-contractors are obligated to obtain a building permit from Pocono Township. You are obligated to notify ALLOA prior to starting any building activity. This includes clearing a lot, digging a foundation, laying in the foundation, any structural work, etc. If an approved building permit is not present on the site, the lot owner is fined $100.00 and a "STOP WORK ORDER" shall be posted by the Board. All new construction sites must have a "porta john" on premise until the new septic system is installed. Same fines and penalties are applicapable.   Your Board has just concluded a case involving a deed convenent with the former owner of the northern tract of land which is now owned by LTS/Brookside Farms. In order to better understand what occurred, I will first give you the background information. The northern end of the lake was owned by the Catitta family. Their original farmhouse still stands, though unoccupied for now. A portion of their land flooded out in 1968 when a beaver got into the stream that feeds our lake and built a dam. The owner, Joseph Catitta sold us (LAKE REALTY) a 3.68 acre parcel which is basically the northern tip of the lake, in effect giving us total ownership of the lake. In selling us the land, he asked for and was given an easement right to access the lake for "one single family and a reasonable number of their social guests as well limiting the easement to the owner of the Catitta home or it's replacement." The Catitta's rarely took advantage of their given rights. When Mr. Catitta died, his wife then took ownership of the property and she in turn sold it to LTS/Brookside Farms. LTS subdivided the tract of land into parcels and sold them to various owners. One new homeowner built their home next to Alpine Lake and they were under the assumption that they had lake rights. We had our lawyer investigate all property deeds going back to 1930 and he found that only the Catitta house has rights to the lake. Any new homes built upon the former Catitta land tract do not have access to our lake and property. Our lawyer is advising these home owners of his findings. We will post our property on 9/23/06. A book of deeds and surveys will be established by the Board for reference by future Boards, thereby making their responsibilities much clearer and know that we have not set any precedents that will jeopardize Alpine Lake and its private status.   Mold remediation is a buzz word phrase that is becoming more and more of a problem, especially for those of us who live in the Poconos. This newsletter cannot fully address all of the issues behind mold problems. When in doubt, hire a pro! An article from the CAI booklet states "Although you can tackle small jobs in-house, there are instances when you should call a pro. (1) The contaminated area will take more than 4 hours to remediate fully or is greater than 10 square feet. (2)You may compromise building occupant safety or can't adequately contain the area. (3) You can't provide the adequate worker safety or training. (4) When there is a need for documentation, ie, you're selling or renting the home, etc.

  Under the PA Planned Community Act, as a member of a private community, you have every right to view personal and financial records of ALLOA with a written request to the Board with a "proper purpose" that insures that you will not financially benefit from viewing those records. The Board has had only one person, member Steve Garvey, who has reviewed your personal records. Garvey has reviewed your personal records twice and the last time was November 15, 2008. Should you be contacted by any member of ALLOA that has reviewed your personal records and you feel that your personal records are going to financially benefit that individual, please contact the Board.   Over the years a series of ditches have been dug along side the roads throughout Alpine Lake. The drainage ditch pipe that is under your driveway is crucial in bringing rain and flood water down to the lake. The recent rain storm we had, saw flooding in all areas where lot owners did not clean out the leaves and debris from their driveway drainage pipes. Please remember, it is your responsibility to keep your driveway drainage pipe clear of debris. Any questions can be forwarded to Gordon Holz.

  The paving has been completed for 2009. Brian Liernan has done an excellent job in securing the lowest possible cost for our latest paving addition. Brian will look at the 2010 scehdule and make that announcement later in the year.

  The Board would like to mention to all ALLOA property owners that are renting their homes, either on a permanent basis or on a weekend basis, that YOU are responsible for your tenant's activities. The ALLOA Board will not hold your renters responsible when they violate any of ALLOA Bylaws, we will hold YOU responsible. You will be billed time and material for any damages that they are involved in and YOU will be fined for any infractions against this community. Please, take time to type out a specific set of guidelines for your renters so that they know specifically, what they can or cannot do. (NOTE) This also includes having a valid fishing license and observing the catch and release rules for our lake. Boat safety is always a must, make sure they are aware of having a life vest for each person on the boat and do not overload the boat.

  Our contractor who maintains our lake has indicated through written report that our lake is healthy and sound. Eco-scientific Solutions performs our monthly checks for algae, fecal count from the geese and water samplings as well as ph levels and oxygen content. We scored well within the parameters throughout last season. Remember, the health of our lake is a community effort. Watch what you spill in your yard, runoff will take it to the lake.

  Some 5 years ago, the community came together in requesting that something be done about the quads, atvs, trail bikes, etc that were being driven on our private roads within Alpine Lake. Please take the time to read thru this so that you are aware of what you can do and what you cannot do in regards to these sport vehicles. First off, everyone is governed by PENNSYLVANIA'S ALL TERRAIN VEHICLE LAW. Nothing has changed there. A recreational vehicle can only cross a township road, you cannot ride the length of a road in any distance, see state exceptions. The driver must be 16 years of age, no exceptions. quote "NO ONE UNDER 8 YEARS OF AGE SHALL OPERATE AN ATV ON ANY STATE OWNED PROPERTY. NO PERSON FROM THE AGE OF 8 TO THEIR 16TH BIRTHDAY SHALL OPERATE AN ATV EXCEPT ON LANDS OF HIS PARENT OF GUARDIAN, UNLESS HE OR SHE HAS COMPLETED A PRESCRIBED ATV SAFTEY TRAINING COURSE AND RECEIVED AN ATV SAFETY TRAINING CERTIFICATE. No person under the age of 16 can access or use the private roads of ALPINE LAKE, no exceptions. The lot owner of any rider not following these guidelines will be fined by ALLOA. Any adult who wishes to ride on ALLOA roads must have permission from the Board. They must present a current & valid insurance policy and the policy must indicate that ALLOA is named as a co-insuree or a party of interest on the binder. You then will be issued a license plate for your sport vehicl. Contact Brian Kiernan for this authorization.

  The Bylaws and Rule & Regulations package that we have been working on for the last two years was finally passed at the June membership meeting. This is a move towards updating the way in which we shall operate as we go forward. Please review your articles and be familiar with them.   We've had another act of vandalism at the lake. Some 5 to 6 row boats have been stolen over the week of January 23, 2010. This is an area where it would be quite easy for a pickup truck to simply back up to the boats, jump out of the truck, throw a boat into the pickup and leave the area unobserved. PLEASE LOCK YOUR BOATS TO THE POLES. ALLOA is not responsible for any boats and/or equipment left in the area. We have made a Police report so if you can determine if your boat is one of the stolen boats, please contact the Pocono Township Police. In order to aid the Police in any kind of theft, you should MARK YOUR BOATS WITH YOUR LOT # and paint "ALPINE LAKE" on the bottom for extra recognition.

  There is an old saying, "it ain't a sale if you don't need it." There are three types of sales of property in the Pocono's. Step (1) is the UPSET TAX SALE, (2) The JUDICIAL TAX SALE and (3) The REPOSITORY SALE. Be careful as to which one you purchase your "dream home" under. Your purchase may seem like a steal, but when you get home, you might find that you bought a beautiful lot or home with a few hidden warts, such as liens, encumbrances and mortgages! Do your homework and due diligence will prevail. In order to protect your rights and interests, we urge you to contact a lawyer prior to purchase of any property at any tax sale.
